is a space dedicated to designing and testing strategies to address to the global crisis of corporate impunity. A series of United States Supreme Court decisions over the past decade have made it increasingly difficult to hold corporations accountable for violations committed overseas. Corporations often evade accountability for abuses like forced labor, union busting, and sexual and gender-based violence, especially when harms occur transnationally. As a result, impacted workers and communities are left without justice. CAL’s Design Lab is a research and development hub where we incubate non-traditional legal strategies, build connections, conduct research, and facilitate strategic and collaborative spaces using design thinking processes and mindsets. CAL’s innovations are not meant to stay in the Lab--they are most useful when brought to the field, the factory, and the courtroom. Through projects like the Brain Trust, Idea Bank, Civil Litigation Skillshare, and Corporate Liability and Sustainable Peace (CLASP) Lab, CAL is always refining and building on our innovations, learning about other ideas, and testing what is promising in the real world. https://images.squarespace-cdn.com/content/v1/5810dda3e3df28ce37b58357/1636575277443-A2IAAIURW6FXSRQVQSEK/unsplash-image-InufphpCMm0.jpg Programs - Combating Forced Labor Across the world, 25 million people are subject to forced labor in industries that range from cocoa to cotton to coffee. Additionally, an estimated 79 million children are engaged in hazardous child labor, which is one of “the worst forms of child labor.” Young children use machetes, carry heavy loads, spray pesticides, and do other dangerous tasks, all forms of hazardous child labor that children are incapable of consenting to. Child labor that requires children to work at the expense of their health, schooling, or well being must be considered forced. Forced labor and exploitative labor practices are not “errors” in supply chains. Rather, such practices are a feature of the global economy that Global North companies and consumers benefit from. Multinational companies pay unsustainably low prices for goods, thereby squeezing suppliers and leading factories and farmers to cut costs however they can, including by using illegal forms of labor. CAL aims to develop new strategies to combat the use of forced labor in global supply chains. We’ve pioneered new uses of the Tariff Act of 1930, filed a groundbreaking consumer protection case, written amicus briefs for a Supreme Court case on forced child labor, and investigated opportunities to use unfair competition rules to block goods produced with human rights abuses. Foreign and domestic companies, large and small, leverage conflicts so that displacement, intimidation, and land grabbing by governments and illegal armed groups align with their business interests. Yet when societies enter formal and informal transitional justice processes for both legal justice and social reckoning with the atrocities that occurred, corporate actors are often ignored. This impunity leaves impacted communities without redress, maintains abusive power structures, and undermines sustainable peace. CAL uses a human-centered approach to holding companies and other economic actors accountable, by centering victims, survivors, and affected communities in designing strategies. Unfortunately, IP is not always used as its creators intend, especially in the tech industry, where creators’ work can be used by companies (and government partners from the US and abroad) in ways that harm people and the planet. In the past, this has been accepted as part of the traditional approach to open source projects. The Ethical Source Movement promotes a pro-social and ethical alternative, focusing on justice and equity as essential components of thriving open source communities and projects. Together, CAL and our partners at the Organization for Ethical Source have developed a number of licenses and IP assignment clauses allowing tech workers to embed human rights and environmental conditions into their licenses. The licenses give tech workers several options, ranging from a license with the broad inclusion of human rights law, to an “expanded duty of care” license model, to assignment clauses with specific Five years in, we’re reflecting on the ways we have challenged the exploitative models major companies rely on across various industries. We have tested supply chain contract language that works for workers – by ensuring that, wherever they are in the world, they have the right to seek justice when they are hurt or their rights are violated. Ethically tainted Brazilian beef and tallow have contaminated U.S. supply chains, undercutting the market for ethically-produced beef. While countries like Thailand, China, and Bangladesh have faced criticism for similar abuses, India, which supplies almost 40 percent of U.S. shrimp imports, has remained under the radar with little public scrutiny – until now. Workers report systematic abuses in including withholding of wages and identity documents, forced overtime, and degrading living conditions, even on ethically certified farms. Through sustained ethnographic research, this report gathers the words of workers on plantations selling to Driscoll’s and Andrew & Williamson Fresh Produce, plantations that are certified “fair trade” by Fair Trade USA and “Responsibly Grown, Farmworker Assured” by the Equitable Food Initiative. Over 200 interviews with workers helped shape the findings of this report, which belie the claims of both brands and certifiers about product sustainability and show how multi-stakeholder initiatives often fail to protect human rights. Forced labor continues to exist — and is legal under state and federal law — due to a simple clause in the 13th Amendment to the United States Constitution, a mere 14 words that provide the basis for a system that incentivizes mass incarceration, racial injustices, and corporate exploitation. We believe that the US prison labor industry is in violation of international law, and recommend several short term actions to improve the lives of incarcerated people. However, no amount of protection can rid the prison system of forced labor indicators like abuse of vulnerability, restriction of movement, and isolation. Cocoa farmers’ livelihoods, precarious in normal times, became even more uncertain. For decades, multinational companies have reaped massive profits while cocoa farmers have earned poverty wages. Farmers are often unable to support their families on such low incomes, much less pay adult workers fair wages. As a result of these, farmers generally hire migrant workers at very low wages, rely on their children to help on the farms, or, in some cases, buy trafficked children. As a prerequisite for obtaining the loan, COCOBOD, the government agency that runs Ghana’s cocoa industry, established an Environmental and Social Management System (ESMS) with a grievance and redress mechanism. It is based on survey responses from factory managers and oral interviews with three prominent Bangladeshi union leaders and labor activists. Among the insights drawn from this research, Dr. Khan finds that while some initiatives did have a positive impact on building safety, their impact on social compliance, including labor rights, was much more limited. Rubicon August 2023 CAL, Global Labor Justice-International Labor Rights Forum, and the Law Offices of John Burton filed an amicus brief supporting the plaintiffs in Ratha v. Rubicon, a case brought by Cambodian victim-survivors of human trafficking and forced labor under the Trafficking Victims Protection Reauthorization Act (TVPRA). CAL and our partners filed this brief on behalf of more than twenty human and workers’ rights organizations and U.S. shrimp producers. The brief argues that when the defendant company Rubicon Resources, LLC (Rubicon) attempted to benefit from selling shrimp sourced from a shrimp processing facility in Thailand, Rubicon “knew, recklessly disregarded, and/or should have known” about the forced labor occurring there. Chiquita July 2021 Corporate Accountability Lab filed an amicus brief asking the US Supreme Court to grant certiorari in Doe v. Chiquita Brands International. The case was brought by the family members of trade unionists, banana workers, political organizers, social activists, and others targeted and killed by the United Self-Defense Group of Colombia (Autodefensas Unidas de Colombia, AUC), a right-wing paramilitary organization in Colombia funded in part by Chiquita, the US-based multinational banana company. The brief argues that the protective order that allows them to proceed without their names, addresses, phone numbers, or employment information being revealed to the public should not be lifted, as revealing the petitioners’ identities would put their lives at risk. This report examines human and labor rights abuses in the agro-export enclave of Mexico’s San Quintin. Through sustained ethnographic research, this report gathers the words of workers on plantations selling to these brands, plantations which are certified “fair trade” by Fair Trade USA and “Responsibly Grown, Farmworker Assured” by the Equitable Food Initiative. These certified products are found in the supply chains of two major companies, Driscoll’s and Andrews & Williamson. The latter is less of a household name, but sells berries under the Good Farms and Heritage brands to Costco. We brought suit under the Washington, D.C. Consumer Protection Procedures Act (“CPPA”), a consumer protection statute that allows public interest organizations like CAL to sue on behalf of the general public. It’s a program that has been opposed by farmworker and human rights organizations since it was first announced. Now that there is yogurt on the shelf, but still no final standard released, this report looks at the label claims and evaluates “Fair Trade Dairy” based on the available standards. Finally, the report also reviews the rising tide of research that shows that corporate-developed and led certifications are inadequate and points instead to existing models that are better suited to defending workers’ rights and safety. Organized workers are pushing policy changes across the country, improving wages and winning vital workplace protections. Through a series of first-hand interviews and documentation, the report chronicles toxic chemical exposure and wage theft by Fyffes subsidiaries, as well as their violent union-busting campaign once workers organized. The report also details the response of supermarkets, fair trade certifiers, ethical labels, and international governmental organizations to Fyffes workers’ rights violations. It is high time Fyffes takes responsibility to remedy injustices on their plantations and commits to a legally-binding, enforceable agreement to uphold workers’ rights.
